NOTICE OF PROCESSING OF YOUR PERSONAL DATA

Processor, controller and purpose.
Closed Joint Stock Insurance Brokerage Company “Altas draudimo brokeris” , legal entity code 135526534, registered office address Kalniečių g. 104, Kaunas LT – 50184 (Insurance broker) collects and processes your personal data for the following purposes: to assess your insurance needs and to provide you with an insurance offer relevant to you; to intermediate you in concluding an insurance contract with an insurance company; for the purpose of administration of the insurance contract; to ensure our legitimate interests and to develop our services. We only process your personal data on the basis of a lawful basis for processing. We may also process your personal data on other legal grounds where necessary in accordance with the law, after duly informing you.

Depending on the purpose of the processing of your personal data, the Insurance Broker acts either as a controller of your personal data or as a processor of your personal data:

1. The insurance broker acts as a controller of your Personal Data when:

1.1 Assesses your insurance needs. We process your Personal Data in order to assess your insurance needs (e.g. what type of insurance is relevant for you, which risk group you fall into, etc.) and to provide you with the most relevant and best-suited offer for your needs.

1.2 Administer your insurance contract. Your Personal Data is processed for the purpose of administering an existing insurance contract, i.e. y. keeping track of your policy’s expiry date in the policy accounting software, your premium payments, requests for offsetting premiums when you want to cancel your insurance contract, etc. actions related to the administration of the insurance contract.

1.3. Offer their services to you. Your personal data is processed in order to provide you with relevant information about Our services (including those provided in conjunction with Our partners, such as your mobile operator), and to seek your opinion about them.

1.4 Protect their rights and interests. We process your Personal Data in order to exercise and defend our rights, e.g. when we provide your data to a court, bailiff, lawyer representing us or any other person.

1.5. develop, design and improve the quality of its services. To the minimum extent necessary for business purposes and, where possible, on a de-personalised basis, your Personal Data may be processed, e.g. to analyse usage patterns and trends, to get to know the customer, his/her expectations and to develop services.

In this case, t. y. where the Insurance Broker is the controller of your Personal Data, the Insurance Broker acts independently without being instructed by the insurer to process your Personal Data.

2. The insurance broker acts as a processor of your Personal Data when:

2.1 Provides you with the most appropriate offer for an insurance contract to meet your needs. We process your Personal Data in order to assess your insurance needs and provide you with an offer that best suits your needs.

2.2. Insurance mediation. We process your Personal Data in order to facilitate the conclusion of an insurance contract with an insurance company. The insurance broker processes your Personal Data on behalf of the insurers and only for insurance purposes, to provide insurance quotes and/or to conclude an insurance contract. Your Personal Data is collected, processed and transmitted to insurers only to the extent and to the extent necessary for the performance of the Insurance Broker’s functions, i.e. y. provide the best insurance product for your needs and broker your contract.

In this case, t. y. where the Insurance Broker is the processor of your Personal Data, the Insurance Broker acts on behalf and under the control of the insurers (the controllers of your Personal Data).

Personal data processed and basis for processing.
The insurance broker, as a data controller, will process the following Personal Data(Personal Data) in order to assess your insurance needs, to administer the insurance contract, to offer you services, to safeguard its rights and legitimate interests and for the purposes of developing/improving the quality of its services(for more details, please refer to Clause 1):

1. Your identification, contact and operational data (name, surname, personal identification number, job title, residential address, telephone number, email address, bank account, bank name, website address, type and category of activity, customer status);

2. Insurance policy details (type of insurance, series and number of the insurance policy, date of entry into force, expiry date of the insurance policy, expiry date of the authorisation granted by the client, sum insured, premium amount, date of payment of premiums, amount of premiums received, number of the premium payment document, period of insurance, name of insurer);

3. Insurance premium payment and account details (name of the payer, purpose of the premium, due date, amount of the premium, date of payment, payment order number, whether the premium is paid directly to the insurer, bank account number, policyholder’s debt, whether the premium payment is deferred);

4. Reports generated by us to insurers (Data Controllers) (policy number, date, type of insurance, policyholder’s name, surname, personal identification number, premiums paid/not paid, how premiums were paid (cash, bank transfer, card));

5. Identification details of the prohibited object (address of the insured property, unique number, year of construction, copy of the vehicle registration certificate, make/model of the vehicle, type, engine capacity, engine cylinder capacity, registration number, body number and type, identification number, year of manufacture, purpose of use, number of doors and seats, level of alarm system, alarm system, photographs of the insured property, details of damage to property).

The insurance broker, as a data processor, will process the following personal data concerning you and persons related to you (e.g. beneficiaries) in order to provide you with an insurance offer that best suits your needs and to assist you in concluding an insurance contract:

1. Identification data of you and your representative (name, surname, personal identification number, title, title of the representative – title, name, surname);

2. Contact details for you and your representative (residential address, telephone number, email address);

3. Details of the premium payment and the account application (name of the payer, purpose of the premium, due date, amount of the premium, date of payment, payment order number, whether the premium is paid directly to the insurer, bank account number, the policyholder’s debt, whether the premium payment is postponed, the amount of the policyholder’s debt, the amount of the discount amount granted);

4. Identification details of the prohibited object (address of the insured property, unique No., purpose of the property, method of construction, type of material, year of construction, area, copy of the vehicle registration certificate, make/model of the vehicle, type, engine capacity, engine cylinder capacity, registration number, body number and type, identification number, year of manufacture, purpose, number of doors, level of alarm system, alarm system, photographs of the insured property, damage to the property, name of the user of the vehicle, date of the technical passport)

5. Identification and contact details of insured persons and beneficiaries (insured person’s name, surname, personal identification number, date of birth, age, address of residence, telephone number, e-mail address, telephone number, telephone number, e-mail address, etc. postal address, bank account number (to which the insurance benefit is to be paid), name of the document);

6. Identification and contact details of the owner of the insured asset (name, surname, residential address, telephone number, email address);

7. Details of the insurance contract/policy (deductible, risk factors, insured risks, period of insurance, place of insurance, sum insured, amount of deductible, amount of premium, policy number, policy ID number, type/group of risks, group of cover, territory of validity, date of issue of the policy, insured events, driving record, whether the contract was concluded through an insurance broker, insurance options, additional conditions of cover, purpose of the trip, name of the country of destination, risk group, number of payments made, number of insured persons, additional risks, contract number, amount of the unused balance, whether the premium will be offset at the time of cancellation of the insurance contract, building insurance option);

8. Information about your debt obligations (details of policies in force (in force/invalid/stopped/terminated, amount of debt).

 

Source of personal data. The Insurance Broker, acting both as a data controller and as a data processor, receives your Personal Data directly from you (when you provide the data upon request or voluntarily), from third parties (e.g. insurance companies, etc.), from public sources (e.g. from the Register of Real Estate of the State Enterprise Centre of Registers).

 

Recipients of personal data. The insurance broker transfers your Personal Data to insurance companies (insurers) for the purpose of providing you with an offer, concluding an insurance contract and executing/administering the insurance contract (acting both as a data controller and as a data processor). Your personal data may, to the minimum extent necessary for the specific case, be transferred to a third party providing services to the Insurance Broker, including legal, financial, tax, business management, personnel administration, accounting advisors, and to the competent public authorities (e.g. bailiffs, lawyers, etc.) as provided for by law.

 

Duration of storage of personal data. The insurance broker, acting as a data controller, shall keep insurance documents (e.g. offer to conclude an insurance contract, insurance policy, request for cancellation of the insurance contract and for the credit/refund of the unused premium, etc.), other than the insurance contract, for the entire duration of the contract and for a period of 1 year (upon the expiration of the term of the insurance contract), after which they shall be destroyed in a secure manner, unless there is no legal basis for the further processing of your Personal Data. The insurance broker, acting as a data controller, shall keep the insurance contracts for the entire duration of the contract and for 10 years after the destruction of the contract, after which it shall securely destroy them if it does not have a legal basis to process your Personal Data. The insurance broker, acting as a data processor, does not store the Personal Data as it is stored by the insurers (data controllers), who set the data retention periods.

 


Conditions for processing personal data
. Your personal data may be collected, stored, processed, including disclosed, whether in digital form or in tangible or paper form, by any means, including by email. mail and internet connection, which, given the nature of the data processed, ensure secure processing and prevent unauthorised access to your personal data. The insurance broker, acting as a data processor, will process your Personal Data in accordance with the instructions of the data controllers (insurers).

 


Your rights.
In cases where the Insurance Broker processes your personal data as a data controller, you have the right to know about the processing of your Personal Data, to contact the Insurance Broker by e-mail. email address ad_brokeris@altas.lt with a request to access your Personal Data and obtain a copy of the Personal Data processed, to correct inaccurate Personal Data, to delete Personal Data or restrict its processing, to transfer Personal Data, to withdraw your consent to the processing of your Personal Data, if such consent was previously given, or to notify you of the fact that you do not agree to the processing of your Personal Data. You may lodge a complaint with the State Data Protection Inspectorate regarding unlawful processing of your Personal Data. You must provide all your Personal Data to the Insurance Broker, as it will not be possible to conclude the insurance contract without this data. If you object to the Insurance Broker’s processing of your Personal Data for the purpose and in the manner specified, please do not fill in or sign the questionnaires and questionnaires provided by the Insurance Broker. You may also object to the processing of your Personal Data at a later date by informing the Insurance Broker by e-mail. ad_brokeris@altas.lt. If you do not sign the form or object to the processing of your Personal Data, the Insurance Broker will not provide brokerage services, which will result in the conclusion of the insurance contract.

 

In cases where the Insurance Broker acts as a data processor, you have the right to exercise the above rights (the right to access your data, obtain a copy of the processed data, correct inaccurate data, delete and restrict the processing of your data, to have them transferred, etc.), by contacting the Insurance Broker at the following e-mail address. at ad_brokeris@altas.lt. The insurance broker will forward your requests to the controller of your personal data (the insurer with whom you have concluded a contract and for whom you are applying in order to exercise your rights as a data subject) in order for the latter to enable you to exercise the rights set out above. The insurance broker will use its best endeavours to cooperate with the data controller in order to protect your rights. You can contact the State Data Protection Inspectorate regarding unlawful processing of your Personal Data.

 

Persons (insured persons, beneficiaries, owners of the insured property) whose Personal Data you provide in the questionnaire/questionnaire have not been and will not be informed by the Insurance Broker of the processing of their Personal Data as specified in the notice to you on the processing of Personal Data, as this processing is carried out in accordance with Article 95(4) of the Law of the Republic of Lithuania on Insurance, which stipulates that an insurance broker, when concluding and executing an insurance contract, is entitled to process the Personal Data of an insured person, a beneficiary and an insurance premium payer without their consent.
